Booking Terms and Conditions

This Equipment Hire Agreement (“Agreement”) is made between:

​

Airspace Events (“the Supplier”), and
the Customer (“the Hirer”),

collectively referred to as “the Parties.”

​

By confirming a booking with Airspace Events, the Hirer acknowledges that they have read, understood, and agreed to the terms and conditions set out in this Agreement.

1. Damage.

 

1.1 In the event that the Equipment is found to be damaged, missing, or in need of cleaning or repair, Airspace Events will invoice the Hirer for the full cost of such repair or replacement within seven (7) days of collection.

 

1.2 If substantial damage has occurred hirer is required to contact Airspace Events immediately.

1.3 Airspace Events reserves the right to invoice for loss of income and business caused by damage.

​

1.4 When damage has occurred, Airspace Events will invoice the hirer for the full amount. Late payments will accrue interest at a rate of 5.00% per day. 

 

2. Weather and Safety Conditions

 

2.1 Party Tents and other outdoor structures must not be erected or used during severe or unsuitable weather conditions.

 

2.2 Airspace Events reserves the sole right to decline setup or to cancel any booking if, in its reasonable opinion, the site or weather conditions pose a safety or operational risk.

 

2.3 Should Airspace Events exercise this discretion, the Supplier may choose to reschedule the booking, issue a credit, or refund part or all of the booking fee, as deemed appropriate.

 

2.4 If the Hirer chooses to cancel a booking due to forecasted or actual weather, at least forty-eight (48) hours’ written notice must be provided. Acceptance of such cancellation requests is entirely at Airspace Events’ discretion.

 

2.5 Where an event is shortened or interrupted due to a change in weather conditions, any refund or credit will be determined solely by Airspace Events.

 

3. Setup, Collection, and Additional Charges

 

3.1 The booking fee includes delivery, installation, and collection of the Equipment within a twenty five kilometer (25 km) radius of Auckland CBD.

3.2 Deliveries beyond this radius will incur an additional delivery charge, to be quoted in advance.

 

3.3 Standard collection times are as follows:For bookings of up to eight (8) hours the latest collection time is 11:00 pm.Any collection after 11:00 pm is classified as an “Overnight Hire.” and collection will be scheduled for the following morning.

 

3.4 Overnight Hires must have Equipment ready for collection by 8:00 am the following day. Additional fees apply.

 

3.5 All bookings must be paid, in full, for the booking to be confirmed.

4. Cancellations

 

4.1 Airspace Events acknowledges that unforeseen circumstances may arise and will make reasonable efforts to accommodate rescheduling requests.

 

4.2 If a booking is cancelled within one (1) week of the hire date, without reasonable explanation, no refund will be given.

 

4.3 If cancellation occurs more than two (2) weeks prior to the hire date, all sums paid will be refunded.

 

4.4 Should an event be terminated early due to misuse, negligence, or safety risks, any refund or credit will be at Airspace Events’ discretion.

 

5. Health and Safety

 

5.1 Upon installation, Airspace Events will brief the Hirer (or their nominated representative) on safe operating procedures and all relevant Health and Safety obligations.

 

5.2 The Hirer accepts full responsibility for ensuring that these procedures are followed at all times during the hire period.

 

5.3 Airspace Events accepts no liability for any injury, death, or property damage arising from misuse of the Equipment or failure to comply with safety instructions. The Hirer agrees to indemnify Airspace Events against all such claims, costs, or losses.

 

5.4 The Hirer must ensure that at least one responsible adult is present for the entire hire period to supervise use of the Equipment and enforce safety requirements.

 

5.5 If the Hirer is unable to provide adequate supervision, Airspace Events may supply a security attendant at the Hirer’s expense. Payment for such services is due within twenty-four (24) hours of invoicing.

 

5.6 During warmer conditions, Party Tents may experience elevated internal temperatures. The Hirer is encouraged to plan accordingly and may hire a three-speed fan from Airspace Events at a rate of $20 per booking, or use their own fan or air-conditioning unit, provided it complies with all safety requirements.

 

6. Permits and Compliance

 

6.1 Where the event takes place in a public area or venue requiring Council or other authority approval, the Hirer is solely responsible for obtaining all necessary permits.

 

6.2 Party Tents supplied by Airspace Events are considered temporary structures under 100 square metres (100 sqm).

 

6.3 Airspace Events accepts no responsibility for fines, penalties, cancellations, or enforcement action arising from the Hirer’s failure to obtain appropriate authorizations.

 

7. Cleaning and Maintenance

 

7.1 The Equipment must be returned in a clean, dry, and undamaged condition.

 

7.2 If additional cleaning is required upon return, Airspace Events may issue an additional cleaning invoice, at its discretion.

 

8. Site Requirements and Operational Restrictions

 

8.1 The Hirer must allocate adequate time for setup (approximately two (2) hours) and pack-down (approximately one (1) hour).

 

8.2 A representative must be present on-site to provide access and to receive Health and Safety instructions.

 

8.3 A reliable power source must be available at the Hirer’s expense. If the nearest outlet is more than thirty (30) metres from the installation site, the Hirer must provide a suitable generator. 

 

8.4 The minimum site dimensions required for safe installation of a Party Tent are 6 metres (width) x 6.5 metres (length) x 5 metres (height).

 

8.5 The ground surface must be flat, stable, and free of mud, sharp objects, or debris. Airspace Events will not install tents on sloped or unsafe terrain.

 

8.6 The Hirer must maintain adequate inflation and secure anchoring of inflatable structures during the entire hire period.

 

8.7 The Hirer must not modify, alter, or tamper with any part of the Equipment.

 

9. Prohibited Activities and Items

​

9.1 The following are strictly prohibited inside or near the Equipment

​​​​​

  • Smoking, open flames, cooking appliances, or heat sources.

  • Glassware, sharp objects, or any item capable of puncturing or tearing surfaces.

  • Animals of any kind.

  • Food

  • Chewing gum

 

9.2 Entry and exit points must remain unobstructed at all times.

 

9.3 No person is permitted inside the tent or structure during setup or dismantling.

 

9.4 Reckless or unsafe conduct that could cause injury or property damage is strictly prohibited.

 

9.5 In the event of blower or inflation failure, all occupants must immediately exit the structure and contact Airspace Events without delay.

 

10. Capacity and Use

 

10.1 Maximum recommended occupancy for a Party Tent is forty (40) persons at any one time.

 

10.2 During periods of high temperature, Airspace Events recommends limiting occupancy for health and safety reasons.

 

11. General Provisions

 

11.1 Airspace Events’ decisions relating to safety, refunds, or cancellations are final.

 

11.2 This Agreement constitutes the entire understanding between the Parties and supersedes any prior agreements or representations.

 

11.3 This Agreement is governed by the laws of New Zealand, and the Parties submit to the exclusive jurisdiction of the New Zealand courts.
